Creator program terms

These terms govern the Lullable creator program described at getlullable.com/creators/. "We" and "us" are Tecnologías Stellar, S.A. de C.V., the company behind Lullable. "You" are the creator we approved by email. By using your creator link you accept these terms and our general Terms, which apply where these are silent.

1. Joining

  • You apply by email and we approve, or decline, by email. We may decline for any reason, and we are not obliged to give one.
  • You must be at least 18 and able to be paid by PayPal or Wise.
  • You get one link, getlullable.com/go/yourcode. It is yours to share; it is not transferable.

2. What earns a commission

  • A qualifying download is a first-time download of the Lullable iPhone app that App Store Connect's campaign report attributes to your code, within Apple's attribution window (currently 24 hours from the tap, most recent link wins).
  • Re-downloads, installs on your own devices or by people you pay or otherwise induce to download, and any download Apple flags or reverses, do not qualify.
  • Waitlist signups, page views, clicks and newsletter subscriptions earn nothing. We report signups to you as a courtesy; they are not a commission event.
  • Apple's report is the sole record. If Apple does not show it, we cannot pay it. Apple does not show a campaign until it reaches five first-time downloads.

3. What we pay

  • US$0.50 per qualifying download.
  • During the pilot, commissions are capped at 500 qualifying downloads per creator per calendar month. We will tell you in writing when the cap changes.
  • We may change the rate or the cap with 30 days' notice by email. Downloads before the change are paid at the old rate.

4. Statements and payment

  • On or about the 1st of each month we send you a statement of qualifying downloads for the previous month.
  • We pay 30 days after the statement, by PayPal or Wise to the account you gave us, in US dollars. Fees your provider charges are yours.
  • If your balance is under US$25 it rolls forward and is paid once it reaches US$25. On termination we pay whatever is owed, even below the threshold, within 60 days.
  • You are responsible for your own taxes. You are an independent contractor, not our employee, agent or partner. If you are a US person we may ask for a completed Form W-9 before paying.

5. What you may not do

  • Bid on, or run ads against, the word "Lullable" or its misspellings, or list your link on coupon, deal, cashback or incentive sites.
  • Refer yourself, pay or reward people for downloading, or generate downloads by any automated means.
  • Send unsolicited messages, post in places whose rules forbid it, or present yourself as Lullable.
  • Make any medical or outcome claim about the app: nothing about treating, curing or fixing a condition, nothing about results, nothing "proven" or "recommended". Lullable is not a medical device.
  • State a price for the app, or offer a discount, unless we have given you one in writing.
  • Ask people to leave a review or a rating, or offer anything in exchange for one.

6. Disclosure

  • You must disclose, clearly and before or at the start of any mention, that Lullable pays you when people download through your link. In audio, say it; in video, say it or show it on screen; in text, write it where the mention begins. A tag in the description alone is not enough.
  • This is required under the US FTC Endorsement Guides, the UK CAP Code, EU consumer law and Mexico's PROFECO guidance, and by us. We will check. A mention without disclosure earns nothing and may end the agreement.

7. Withholding and reversal

  • We may withhold or reverse commissions where we reasonably believe a download did not qualify, or that you have breached these terms, and we will tell you why.
  • If Apple revises a figure, our statement follows Apple's revision.

8. Our brand

  • We give you a revocable, non-exclusive, royalty-free licence to use the Lullable name, logo, app icon and the assets in our press kit to promote the app while you are in the program, unaltered.
  • Apple's App Store badge and device images are Apple's, and must be used as Apple's marketing guidelines require.
  • Anything you make about Lullable is yours. You give us permission to quote or share it, with credit.

9. Ending it

  • Either of us can end this by email at any time, no reason needed. Your link stops earning at the end of that day. Commissions already earned are still paid under section 4.
  • We may end it immediately for a breach of sections 5 or 6.

10. The rest

  • Nothing here makes you our employee, agent, or partner, and you may promote whatever else you like.
  • We are not liable to you for lost profits or indirect loss, and our total liability under these terms is the commissions owed to you.
  • These terms are governed by the laws of Mexico and the courts of Mexico City, as set out in our general Terms.
  • We may update these terms; changes take effect 30 days after we email you. If you keep using your link after that, you accept them.
